These Terms of Service (“Terms”) govern your access to and use of dumpstersidekick.com and any related services (the “Service”) provided by DumpsterSidekick (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Please read these Terms carefully. They contain important provisions including a binding arbitration agreement, a class action waiver, and a limitation of our liability. These provisions affect your legal rights.
1. What DumpsterSidekick is
DumpsterSidekick is an online directory of dumpster rental companies and a quote-request routing service. We are not a dumpster rental company. We do not own dumpsters. We do not deliver, pick up, or service dumpsters. We do not set prices, schedule deliveries, or perform any rental operations.
The Service consists of two main features:
The Directory: a searchable listing of dumpster rental companies with their business information, service areas, and contact details. You may use the Directory to find and contact haulers directly.
Quote Requests: an optional form that lets you submit a project request, which we then pass to local haulers in your area — up to five. Those haulers may contact you directly to provide quotes.
All actual dumpster rental transactions — pricing, contracts, scheduling, service, payment, disputes — are between you and the hauler. DumpsterSidekick is not a party to any rental agreement.
2. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements.
If you are using the Service on behalf of a business or other organization, you represent that you have authority to bind that entity to these Terms.
3. Quote requests and contact authorization
If you submit a quote request, you understand and agree that:
- The information you provide will be shared with local haulers in your area — up to five
- Each of those haulers may contact you directly using the contact information you provide, including by phone, text message (SMS), or email
- You expressly consent to receive these contacts, including by automated dialing or prerecorded messages, and you understand that consent is not a condition of any purchase
- You can opt out of contact from any specific hauler by telling them directly
- You can opt out of all future sharing at any time using our Do Not Share My Personal Information page, or by emailing support@dumpstersidekick.com with the subject line “Do Not Share”
- Standard message and data rates may apply to any text messages you receive
Opting out prevents future sharing. It does not retract information already sent to a hauler.
This consent is required for haulers to lawfully contact you under the U.S. Telephone Consumer Protection Act (TCPA) and similar state laws. By checking the consent box on the quote request form, you are providing this consent. We keep a record of that consent, including the date, time, IP address, and the exact language shown to you.
4. No relationship with haulers
Haulers listed in our Directory and haulers who receive quote requests are independent businesses. They are not employees, agents, partners, or representatives of DumpsterSidekick. We do not control or supervise their work, and we make no representations about their qualifications, licensing, insurance, pricing, or service quality.
Listing information is compiled from third-party sources and information supplied by the businesses themselves. It may be incomplete, out of date, or inaccurate. Inclusion in the Directory is not a recommendation, endorsement, or verification of any hauler.
Before booking with any hauler, you should independently:
- Verify their licensing and insurance
- Confirm their pricing in writing, including weight allowances, overage rates, and any surcharges
- Review their cancellation, damage, and dispute policies
- Read independent reviews and check their standing with the Better Business Bureau and your state attorney general’s office
5. No warranties
The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Service will be uninterrupted, error-free, or secure
- Warranties about the accuracy, completeness, or reliability of any content on the Service, including hauler listings, pricing information, permit data, prohibited items lists, and educational guides
- Warranties that any hauler will provide quality service, accurate quotes, or any service at all
Permit data. Permit requirements, fees, processing times, and prohibited-item rules are provided for general informational purposes only. They are not legal advice. Municipal rules change frequently and vary by jurisdiction, and our data may be incomplete or out of date. Always verify permit requirements directly with the relevant municipal authority before placing a dumpster.
6. Limitation of liability
To the maximum extent permitted by law, DumpsterSidekick and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, loss of goodwill, or any other intangible losses, arising out of or related to your use of the Service.
Our total cumulative liability to you for all claims arising out of or related to the Service or these Terms — whether in contract, tort, or any other theory — shall not exceed one hundred U.S. dollars ($100).
This limitation applies regardless of the legal theory of liability and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow limitations on certain damages, so portions of this limitation may not apply to you.
7. Indemnification
You agree to indemnify, defend, and hold harmless DumpsterSidekick and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any law or the rights of a third party
- Any rental agreement, transaction, or dispute between you and a hauler
8. Acceptable use
You agree not to:
- Use the Service for any illegal purpose or in violation of any law
- Submit false, misleading, or inaccurate information through the Service
- Submit quote requests on behalf of someone else without their permission
- Attempt to interfere with the Service’s operation, including by attempting to overload, hack, or reverse-engineer it
- Scrape, copy, or systematically extract content from the Service for commercial purposes without our written permission
- Impersonate any person or entity, including DumpsterSidekick staff or any hauler
- Use the Service to harass, threaten, or harm any other person, including haulers
- Send unsolicited marketing communications to haulers or other users you encounter through the Service
We reserve the right to remove any user, listing, or content that we believe violates these Terms or threatens the integrity of the Service.
9. Hauler-specific terms
If you are a hauler with a listing in our Directory or a recipient of quote requests, the following additional terms apply:
- You represent that you are an active, legal dumpster rental business with the appropriate licensing and insurance for your service area
- You will respond to customer inquiries in good faith and in a timely manner
- You will honor written quotes you provide to customers, subject to legitimate weight overages and disclosed surcharges
- You will not engage in bait-and-switch pricing, false advertising, or deceptive practices
- You will not contact users beyond the scope of the quote request they submitted (no separate marketing campaigns to leads obtained through our service)
- You will comply with all applicable laws, including the TCPA and state consumer protection laws, in your communications with users
- You agree we may remove your listing or terminate your receipt of quote requests at any time, with or without cause, including based on customer complaints
Specific terms for paid hauler products (premium profiles, quote-request delivery) are governed by your separate agreement with us at signup.
10. Intellectual property
The Service, including its design, content, code, and trademarks, is owned by DumpsterSidekick and protected by U.S. and international copyright and trademark laws. You may not reproduce, modify, distribute, or create derivative works of the Service without our written permission, except as expressly permitted by these Terms or applicable law.
You retain ownership of any content you submit to the Service, but by submitting content (such as a quote request, feedback, or hauler listing information) you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display that content for the purposes of operating the Service.
11. Third-party links and content
The Service may contain links to third-party websites, including hauler websites, government resources, and reference materials. We do not control these third-party sites and are not responsible for their content, accuracy, or practices. Your use of any third-party site is at your own risk.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination — including limitations of liability, indemnification, dispute resolution, and intellectual property — will survive.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, any legal action arising out of or related to these Terms must be brought in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.
14. Binding arbitration and class action waiver
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service — except for the limited exceptions listed below — shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will be held in San Diego County, California or, at your option, in your home state.
By agreeing to these Terms, you and DumpsterSidekick are each waiving the right to a jury trial and the right to participate in any class action, collective action, or representative proceeding. Disputes must be brought individually — you cannot bring a claim as a plaintiff or class member in any class or representative action against us.
Exceptions to arbitration: either party may bring an individual action in small claims court for disputes within the court’s jurisdiction. Either party may also seek injunctive or other equitable relief in court for matters relating to intellectual property infringement or unauthorized access to the Service.
Opting out of arbitration. If you do not want to be bound by this arbitration agreement and class action waiver, you may opt out by sending written notice to support@dumpstersidekick.com within 30 days of first agreeing to these Terms. The notice must include your name, contact information, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration will not affect any other provision of these Terms.
15. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page shows when the most recent change was made. Material changes will be announced on the Service, and if you have an active hauler account, we will notify you by email. If you continue to use the Service after changes are made, you accept the updated Terms.
If you do not agree to the updated Terms, your only remedy is to stop using the Service.
16. Miscellaneous
Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and DumpsterSidekick regarding the Service.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms freely.
No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
Headings. Section headings are for convenience only and have no legal effect.
